Terms and Conditions

These terms are the agreement between EXTIN-GO LLC and whoever uses the EXTIN-GO application or the website ext-in-go.com. By creating an account you accept them. If you do not agree, do not use the service.

1. What EXTIN-GO is

A tool for companies that service fire extinguishers, so they can register equipment, keep their inspections and hydrostatic tests, and issue reports and certificates for their customers. It is management software: we do not certify extinguishers, we do not perform inspections, and we are not fire-safety experts.

This one is worth reading twice: the technical and legal responsibility for every service, every certificate and every signature belongs to the company that performs it and to whoever signs it. EXTIN-GO stores and organizes that information; it does not validate it and does not answer for it before any authority.

2. Responsibility for the information and for incidents

All information in EXTIN-GO — extinguisher records, inspections, hydrostatic tests, dates, photographs, signatures and reports — is entered by users: the service company, its technicians, and the customers and corporate staff authorized by them. EXTIN-GO does not generate that information, does not verify it, does not audit it and does not validate it.

Every record represents only what the authorized person who entered it declared. Its truthfulness, accuracy and currency are the responsibility of whoever entered and signed it.

Consequently, and to the fullest extent permitted by law:

EXTIN-GO does not certify, does not inspect, does not issue expert opinions and does not replace any inspection, verification or official ruling. It is not a certifying body, a testing laboratory, nor a fire-protection or civil-defense expert.
The documents produced by the platform are an administrative record of what the user declared. They are not an official ruling, a certification, nor an opinion issued by EXTIN-GO, and they do not by themselves prove compliance with any regulation.
EXTIN-GO does not answer for the actual physical condition of an extinguisher or of any fire-protection system, nor for whether a service recorded in the platform was in fact performed, nor for how it was performed.
Before any authority — civil defense, labor, fire department, insurers or any other — the parties who answer are the company that performed the service and the owner or operator of the premises. Complying with the regulations that apply to a building is the responsibility of whoever occupies and operates it.
EXTIN-GO assumes no civil, criminal, administrative or any other liability for fires, emergencies, contingencies, accidents, property damage, personal injury or death occurring inside or outside any premises, whether or not the equipment involved was recorded in the platform.
EXTIN-GO is not a party to, and assumes no liability in, any claim, lawsuit, proceeding, penalty or inspection brought against a user, a customer of a user, or a property owner.

You hold us harmless. If a claim, lawsuit or penalty is brought against EXTIN-GO LLC arising out of information you entered, a service you performed or failed to perform, or an incident at premises you or your customers service, you agree to hold EXTIN-GO LLC harmless and to cover the reasonable costs of defending it.

Nothing in this section excludes liability that the applicable law does not allow to be excluded.

3. Your account

You must give accurate information and keep it current.
You are responsible for your password and for whatever is done with your account.
If you add technicians or staff, you answer for how they use it.
You must be of legal age and have authority to bind your company.

4. The data is yours

The information you enter — your customers, your extinguishers, your reports and your documents — is yours. We store it and give you the tools to work with it; we do not use it for anything else and we do not sell it.

You can export your reports as PDF at any time from the app.

5. Plans and payments

There is a free plan and paid plans with more capacity. Paid plans are purchased:

On ext-in-go.com, billed through Stripe, or
Inside the application, billed through the App Store or Google Play, depending on the device.

Subscriptions are monthly and renew automatically until you cancel. The price that applies is the one published at the time of purchase.

6. Cancellation

If you purchased on the website: cancel from your profile or by writing to info@ext-in-go.com. You keep the service until the end of the period already paid.
If you purchased inside the app: cancel from the subscription settings of your App Store or Google Play account. We cannot cancel it for you or refund that charge; refunds are handled by the store under its own policies.

Cancelling does not delete your data. Your account moves to the free plan and your information is kept; if you are over the free plan's capacity you will not be able to register more equipment, but we never delete what you already recorded.

7. Plan limits

Each plan includes a number of extinguishers. Once you reach the cap, registering more equipment is blocked until you change plan or add capacity. Existing data stays available to view, export and work with.

8. Acceptable use

You may not use EXTIN-GO to: record false information backing a service that was not performed; impersonate another company or technician; attempt to access another user's information; or resell access to the platform without an agreement with us.

We may suspend an account doing any of those, with notice beforehand unless the harm is immediate.

9. Availability

We work to keep the service available at all times, but we cannot guarantee there will be no interruptions. Scheduled maintenance is done in low-activity hours and announced in advance whenever possible.

10. Limitation of liability

EXTIN-GO is provided "as is". To the extent permitted by law, our total liability to you will not exceed the amount you paid us in the twelve months before the event giving rise to it. We are not liable for lost profits, lost customers, or penalties arising from a service that you performed.

11. Changes to these terms

If something material changes we tell you inside the app before it takes effect. We store the version you accepted when you registered. If you do not agree with the new version, you can cancel and export your information.

12. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without prejudice to the consumer rights granted to you by the law of your country of residence that cannot be waived.

Estos términos son el acuerdo entre EXTIN-GO LLC y quien usa la aplicación EXTIN-GO o el sitio ext-in-go.com. Al crear una cuenta los aceptas. Si no estás de acuerdo, no uses el servicio.

1. Qué es EXTIN-GO

Una herramienta para que las empresas que dan mantenimiento a extintores registren equipos, lleven sus inspecciones y pruebas hidrostáticas, y emitan reportes y constancias para sus clientes. Es un software de administración: no certificamos extintores, no realizamos inspecciones y no somos peritos en protección civil.

Esto importa y conviene leerlo dos veces: la responsabilidad técnica y legal de cada servicio, de cada dictamen y de cada firma es de la empresa que lo realiza y de quien lo firma. EXTIN-GO guarda y organiza esa información; no la valida ni responde por ella ante ninguna autoridad.

2. Responsabilidad sobre la información y sobre los siniestros

Toda la información que vive en EXTIN-GO —registros de extintores, inspecciones, pruebas hidrostáticas, fechas, fotografías, firmas y reportes— la capturan los usuarios: la empresa de servicio, sus técnicos, y los clientes y el personal corporativo que ellos autorizan. EXTIN-GO no genera esa información, no la verifica, no la audita y no la valida.

Cada registro representa únicamente lo que declaró la persona autorizada que lo capturó. Su veracidad, exactitud y vigencia son responsabilidad de quien la capturó y la firmó.

En consecuencia, y en la medida máxima que permita la ley:

EXTIN-GO no certifica, no inspecciona, no dictamina y no sustituye ninguna inspección, verificación o dictamen oficial. No es un organismo certificador, ni un laboratorio de pruebas, ni un perito en protección civil o contra incendios.
Los documentos que genera la plataforma son un respaldo administrativo de lo que el usuario declaró. No son un dictamen oficial, ni una certificación, ni una opinión emitida por EXTIN-GO, y por sí solos no acreditan el cumplimiento de ninguna normativa.
EXTIN-GO no responde por el estado físico real de un extintor ni de ningún sistema contra incendio, ni por que un servicio registrado en la plataforma se haya realizado efectivamente, ni por la forma en que se realizó.
Ante cualquier autoridad —protección civil, autoridad laboral, bomberos, aseguradoras o cualquier otra— quienes responden son la empresa que prestó el servicio y el propietario u operador del inmueble. Cumplir la normativa que corresponde a un inmueble es responsabilidad de quien lo ocupa y lo opera.
EXTIN-GO no asume responsabilidad civil, penal, administrativa ni de ninguna otra naturaleza por incendios, emergencias, contingencias, siniestros, daños materiales, lesiones o pérdida de vidas ocurridos dentro o fuera de cualquier inmueble, hayan estado o no registrados en la plataforma los equipos involucrados.
EXTIN-GO no es parte ni asume responsabilidad en ninguna reclamación, demanda, procedimiento, sanción o inspección que se siga en contra de un usuario, de un cliente de un usuario, o de un propietario de inmueble.

Nos sacas en paz y a salvo. Si se presenta una reclamación, demanda o sanción en contra de EXTIN-GO LLC derivada de información que tú capturaste, de un servicio que prestaste o dejaste de prestar, o de un siniestro en un inmueble que tú o tus clientes atienden, te obligas a sacar a EXTIN-GO LLC en paz y a salvo y a cubrir los gastos razonables de su defensa.

Nada de esta sección excluye la responsabilidad que la ley aplicable no permita excluir.

3. Tu cuenta

Tienes que dar información veraz y mantenerla al día.
Eres responsable de tu contraseña y de lo que se haga con tu cuenta.
Si inscribes a técnicos o colaboradores, respondes por el uso que le den.
Debes ser mayor de edad y tener facultades para obligar a tu empresa.

4. Los datos son tuyos

La información que capturas —tus clientes, tus extintores, tus reportes y tus documentos— es tuya. Nosotros la guardamos y te damos las herramientas para trabajarla; no la usamos para nada más ni la vendemos.

Puedes exportar tus reportes en PDF en cualquier momento desde la aplicación.

5. Planes y pagos

Hay un plan gratuito y planes de paga con más capacidad. Los planes de paga se contratan:

En el sitio ext-in-go.com, con cobro a través de Stripe, o
Dentro de la aplicación, con cobro a través de App Store o Google Play, según el dispositivo.

Las suscripciones son mensuales y se renuevan solas hasta que las canceles. El precio vigente es el que aparece publicado al momento de contratar.

6. Cancelación

Si contrataste en el sitio web: cancela desde tu perfil o escribiendo a info@ext-in-go.com. Conservas el servicio hasta el final del periodo ya pagado.
Si contrataste dentro de la aplicación: la cancelación se hace en los ajustes de suscripciones de tu App Store o Google Play. Nosotros no podemos cancelarla por ti ni devolver ese cobro; los reembolsos los resuelve la tienda conforme a sus propias políticas.

Cancelar no borra tus datos. Tu cuenta pasa al plan gratuito y tu información se conserva; si rebasas la capacidad del plan gratuito no podrás dar de alta más equipos, pero nunca eliminamos lo que ya registraste.

7. Límites de cada plan

Cada plan incluye una cantidad de extintores. Al llegar al tope, se bloquea dar de alta más equipos hasta que cambies de plan o amplíes tu capacidad. Los datos existentes siguen disponibles para consultar, exportar y trabajar.

8. Uso aceptable

No se permite usar EXTIN-GO para: capturar información falsa que respalde un servicio que no se realizó; suplantar a otra empresa o técnico; intentar acceder a información de otro usuario; ni revender el acceso a la plataforma sin un acuerdo con nosotros.

Podemos suspender una cuenta que haga cualquiera de esas cosas, avisando antes salvo que el daño sea inmediato.

9. Disponibilidad

Trabajamos para que el servicio esté siempre disponible, pero no podemos garantizar que no habrá interrupciones. Haremos el mantenimiento programado en horarios de baja actividad y lo avisaremos con anticipación cuando sea posible.

10. Límite de responsabilidad

EXTIN-GO se ofrece "tal como está". En la medida que lo permita la ley, nuestra responsabilidad total frente a ti no excederá el monto que nos hayas pagado en los doce meses anteriores al hecho que la origine. No respondemos por lucro cesante, pérdida de clientes, ni por sanciones derivadas de un servicio que tú prestaste.

11. Cambios a estos términos

Si cambia algo importante te avisamos dentro de la aplicación antes de que aplique. Guardamos la versión que aceptaste al registrarte. Si no estás de acuerdo con la nueva versión, puedes cancelar y exportar tu información.

12. Ley aplicable

Estos términos se rigen por las leyes del Estado de Wyoming, Estados Unidos, sin perjuicio de los derechos que la ley de tu país de residencia te reconozca como consumidor y que no puedan renunciarse.
